  • Secure data storage and retrieval

The Service is provided as a tool to assist healthcare professionals. It does not provide medical advice, diagnosis, or treatment, and should not be used as a substitute for professional clinical judgment.

3. User Responsibilities

3.1 Professional Qualifications

You represent and warrant that you:

  • Are a licensed healthcare professional in good standing
  • Have the legal authority to provide psychological or therapeutic services
  • Will use the Platform solely for lawful professional purposes
  • Will comply with all applicable laws, regulations, and professional standards

3.2 Patient Consent and Data Collection

CRITICAL RESPONSIBILITY: You are solely responsible for:

  • Obtaining Patient Consent: Before using this platform to store any patient information, you MUST obtain appropriate informed consent from your patients
  • Explaining Data Usage: You must inform patients that their information will be stored electronically and may be processed by AI systems
  • Documenting Consent: You must maintain proper documentation of patient consent in accordance with applicable laws
  • HIPAA Compliance: If applicable, ensuring compliance with HIPAA and other healthcare privacy regulations
  • Minor Patients: Obtaining parental or guardian consent when treating minors

3.3 Data Accuracy and Clinical Judgment

You acknowledge and agree that:

  • You are solely responsible for the accuracy of all information entered into the Platform
  • You will verify all AI-generated content (transcriptions, notes, reports) for accuracy before using them professionally
  • You will exercise your independent clinical judgment and not rely solely on AI-generated suggestions
  • You are responsible for all clinical decisions made regarding patient care

3.4 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Using strong passwords and following security best practices

4. Data Ownership and Privacy

4.1 Your Data

You retain all rights, title, and interest in the patient data and content you enter into the Platform. We do not claim ownership of your data.

4.2 Data Processing

By using the Platform, you grant us permission to process your data solely for the purpose of providing the Service. This includes using third-party AI services (OpenAI, ElevenLabs) to provide transcription, analysis, and report generation features.

5. AI-Generated Content

Important Disclaimer: AI-generated content (transcriptions, notes, reports, suggestions) is provided as a tool to assist your professional work. You acknowledge that:

  • AI systems may produce inaccurate, incomplete, or inappropriate content
  • You must review and verify all AI-generated content before using it professionally
  • You are solely responsible for any content you use, share, or rely upon
  • AI suggestions are not medical advice and do not replace professional clinical judgment
  • We are not liable for any errors or omissions in AI-generated content

6. Prohibited Uses

You agree NOT to:

  • Use the Platform without obtaining proper patient consent
  • Share your account credentials with unauthorized individuals
  • Attempt to access other users' data or accounts
  • Use the Platform for any unlawful or fraudulent purpose
  • Introduce malware, viruses, or harmful code
  • Attempt to reverse engineer or copy the Platform
  • Use the Platform to store non-patient-related data or for purposes unrelated to your professional practice
  • Remove or obscure any proprietary notices

7. Intellectual Property

The Platform, including its original content, features, and functionality, is owned by us and protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

8. Service Availability and Modifications

We strive to provide reliable service but do not guarantee uninterrupted access. We reserve the right to:

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or use
  • Professional liability claims
  • Damages arising from AI-generated content errors
  • Damages from unauthorized access to your data
  • Service interruptions or unavailability

YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SERVICE IS TO STOP USING IT.

11. Indemnification

You agree to indemnify and hold harmless Psynthia, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your failure to obtain proper patient consent
  • Your professional services or clinical decisions
  • Any content you submit or share through the Platform

12. Termination

We may terminate or suspend your account immediately, without prior notice or liability, if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time. Upon termination, we will provide a reasonable period for you to export your data before deletion.

13. Governing Law
